GENERAL TERMS AND CONDITIONS OF SALE

The general terms and conditions of sale are fully applicable to any order placed on www.ecofuelbox.com, hereinafter referred to as "ecofuelbox.com" or "Artline International."

Any transaction carried out with ecofuelbox.com, the owner of the website, will be exclusively governed by the terms and conditions of sale detailed below.

PROVISIONS APPLICABLE TO PLACED ORDERS AND CONTRACTS CONCLUDED:

ART. 1
ACCEPTANCE OF THESE GENERAL TERMS AND CONDITIONS OF SALE AND DISCLAIMERS

1.1 - Acceptance of these terms of sale
The act of a user (hereinafter referred to as "the customer") filling out the order form on the website or confirming the order by making the payment constitutes full and complete acceptance of these general terms and conditions of sale, which shall be the only ones applicable to the contract thus concluded.

1.2 - Disclaimer
Our company ensures the distribution of devices (currently not approved in France) strictly reserved for motor racing and disclaims all liability whatsoever regarding any challenge to a manufacturer's warranty, mechanical or electronic breakdown, or insurance coverage. We disclaim all liability for use on public roads.

Please note that any modification or installation, even a simple change of car radio, on a recent vehicle may result in the loss of the Manufacturer's Warranty.
Therefore, the installation may void the warranty offered by the manufacturer.

1.3 - Technical specifications

The condition of the vehicle and the type of engine affect the increase in power generated by our devices. Therefore, the figures provided in our commercial documents indicating quantities of fuel consumed or an increase in power should not be seen as contractual commitments, as they are provided for indicative purposes only.

ART. 2
ORDER CONFIRMATION AND CONTRACT CONCLUSION

Payment for items is made in euros (EUR) only by bank transfer or credit card via PayPal or using the buyer's PayPal balance.
The payment of the item or items by the customer constitutes an order and full acceptance of these general terms and conditions of sale.
ecofuelbox.com reserves the right to cancel an order at any time without any specific reason.

ART. 3
PARTIES' COMMITMENTS IN GENERAL

3.1 - Commitments of ecofuelbox.com
ecofuelbox.com undertakes, except in cases of force majeure, upon acceptance of an order, to deliver the ordered items to the address indicated by the customer at the time of the order, subject to available stocks.

3.2 - Customer's commitments
The customer undertakes to clearly indicate the delivery address during business hours.
The customer undertakes to pay the indicated price for the item to be delivered; the delivery can only be made after ecofuelbox.com has received the payment for said order.
The customer undertakes to take responsibility for compliance with the laws in force regarding the installation and use of the ordered equipment.
The customer undertakes to take all necessary insurance measures regarding the installation and use of the ordered equipment.

3.3 - Right of Withdrawal
In accordance with the provisions of Article L 121-20 of the Consumer Code, the Customer has a right of withdrawal.
This legal withdrawal period is 14 days and applies only to products purchased online.
Thus, the customer has 14 calendar days from the date of receipt of the products to request a return number from ecofuelbox.com's customer service by email or by phone. Once the return number has been obtained, the customer has an additional period of 10 calendar days to return the product to us. Upon receipt of the product, if it meets the conditions specified in paragraph 3.4, the Customer will be entitled to an exchange or refund as desired.

After this 10-day period, the product(s) cannot be returned.
If the Customer has requested a return from Customer Service within 14 calendar days of receiving the products but returns the package more than 10 calendar days after obtaining the return number, only a credit or exchange can be provided, within a maximum of 30 calendar days from the date of receipt of the products. After this 30-day period, the product(s) cannot be returned.
In the event of exercising the right of return by the Customer and in accordance with the provisions of Article L. 121-20 of the Consumer Code, the return costs of the Order are borne by the customer.

The items must be returned in perfect new condition and in their entirety, including accessories, conditioned and packaged as originally, and without any trace of use to allow the resale of the products in question, and accompanied by the original purchase invoice.
Compliance with these conditions will result in a refund by Artline International within thirty (30) days of the amounts paid by the customer and equivalent to the total of the returned products. Shipping and/or handling fees are not refundable. Only complete products returned in their original packaging and in perfect condition for resale and accompanied by the original purchase invoice will be accepted.
For any incomplete, damaged, or non-compliant item, Artline International reserves the right to refuse a refund or charge fees ranging from €69 to €196 to restore the products. In this case, the exact amount will be announced to the customer after verification of the condition of the returned products.
If the customer refuses to bear the restoration costs, the products will be returned to the customer at their expense.

3.4 - Procedure for returning a Product
To exercise the right of return, the Customer must contact Customer Service in advance within the time provided for in this article 10.2, directly from their customer account: My account > My orders > Order details > Merchandise return

The Customer will then receive a return confirmation email containing their return number, known as the RMA.
If the return is due to a change of mind, the Customer must send at their expense part or all of the Order to the address provided by Customer Service.

3.5 - Cancellation
ecofuelbox.com reserves the right to cancel an order at any time without any specific reason.

ART. 4
SPECIFIC PROVISIONS

4.1.1 - Liability of ecofuelbox.com
ecofuelbox.com is in no way liable for direct or indirect damages caused by the purchase and/or use of the ordered items. ecofuelbox.com is in no way liable for any violations of the laws in force caused by the purchase and/or use of the items sold on www.ecofuelbox.com.

4.1.2 - Customer's responsibilities
The customer is solely responsible for direct and indirect damages and violations committed as a result of the purchase and/or use of the items purchased on www.ecofuelbox.com or any other website or distributor selling items supplied through www.ecofuelbox.com in any way.

4.1.2 - Price, invoice
The total price indicated when placing an order with ecofuelbox.com is the final price. This price includes the price of the items, handling fees, packaging, loading fees, and transport costs.
Prices are indicated in euros (EUR).
Payment for items is made in euros (EUR) only by bank transfer or credit card via PayPal, or using the buyer's PayPal balance.

4.2 - Transport – delivery – delivery times
Products shipped by www.ecofuelbox.com are delivered within 2 to 5 days (depending on the chosen carrier) after payment by an accepted means. In all cases, the maximum delivery time is 30 working days. Our items can be delivered worldwide and subject to availability in www.ecofuelbox.com stocks. Deliveries to certain countries are only possible subject to the acceptance of the carrier chosen by ecofuelbox.com

4.2.1 - Ancillary and customs fees
For products coming from countries located outside the EEC, customs and VAT fees may be required upon receipt of the order by the customer. www.ecofuelbox.com in no way participates in the payment of such fees.

4.2.2 - Return – Refund
The return of an item by the customer is not allowed without prior agreement from us, subject to the clarifications mentioned below that concern mail-order sales. Only exchange requests will be favorably considered. The return costs are borne by the customer who is required to return the product in new condition and in its original packaging.

The items must be returned in perfect new condition and in their entirety, including accessories, conditioned and packaged as originally, and without any trace of use to allow the resale of the products in question, and accompanied by the original purchase invoice.
Compliance with these conditions will result in a refund by Artline International within thirty (30) days of the amounts paid by the customer and equivalent to the total of the returned products. Shipping and/or handling fees are not refundable. Only complete products returned in their original packaging and in perfect condition for resale and accompanied by the original purchase invoice will be accepted.
For any incomplete, damaged, or non-compliant item, Artline International reserves the right to refuse a refund or charge fees ranging from 89€ to 289€ to restore the products. In this case, the exact amount will be announced to the customer after verification of the condition of the returned products.
If the customer refuses to bear the restoration costs, the products will be returned to the customer at their expense.

4.2.3 - Warranty
The EcoFuelBox PRO and PRO+ modules are covered by a 3-year warranty.
The warranty contract only applies to the EcoFuelBox PRO and PRO+ modules. If a customer discovers a problem with one of our modules and sends it back to us, the warranty covers the repair or replacement of the module after the malfunction has been verified in our workshops.

In the event that it is necessary to disassemble and reassemble our products, labor costs are borne by the customer who has returned the product to us. Only normal use of the product allows the use of the warranty, which would become void in the event of faulty installation or installation by a person who does not have professional skills and has taken care to check the proper condition and operation of the vehicle as a whole.

In all areas and particularly those defined by Articles 1641 and following of the Civil Code, our warranties are limited to the replacement of defective elements or products and shipping or transportation costs. The customer bears any possible costs related to the assembly and disassembly of the product. Under no circumstances can our company be required to pay damages, regardless of the reason.

Artline International assumes no responsibility for malfunctions or engine damage that may occur after the installation of the kit. Our company will offer no warranty in the following cases: force majeure, negligence, lack of maintenance, non-compliant use, faulty or unprofessional installation.

www.ecofuelbox.com offers a 3 (three) year warranty against any manufacturing defects, under the following conditions:

  • In all cases, the warranty can only apply after examination of the items concerned by the after-sales service of ecofuelbox.com.
  • In the event of disassembly and reassembly of our products, labor costs are borne by the customer who has returned the product.
  • Only normal use of the product allows the use of the warranty, which becomes void in the event of faulty installation or installation by a person who does not have professional skills and has taken care to check the proper condition and operation of the vehicle as a whole.
  • The warranty does not cover any damage directly or indirectly due to the use of the equipment.
  • The warranty does not cover breakage, except for that which occurs during shipment to the buyer and in accordance with the terms set out in Article 4.4 of these terms of sale.
  • No warranty can be applied before the buyer has returned the implicated equipment to www.ecofuelbox.com.
  • Shipping costs incurred for applying the warranty are the responsibility of the buyer.
  • The decision to repair, replace, or refund in part or in full the equipment covered by the warranty belongs entirely to www.ecofuelbox.com

In the event of a dispute regarding the application of these terms of sale, only the Lyon (France) Commercial Court will have jurisdiction.

4.3 - Transfer of Risk
The liability of ecofuelbox.com ceases once the items are handed over to the carrier. The items travel at the customer's sole risk.

4.4 - Reservations upon receipt of products and specific cases of refund/replacement
ecofuelbox.com accepts the validity of the dispute, from the customer, only when the delivered items do not correspond to the quantities or models ordered, or if the package containing the items is seriously damaged before delivery to the customer.
Detailed reservations must be made in writing, dated, and signed on the delivery slip with the carrier upon delivery. A copy or photocopy of the document with the reservations must be sent to ecofuelbox.com (by email or mail) no later than twenty-four (24) hours after making the reservations.

If the above procedure has been followed, and if the claim is proven valid, due to the fact that the package and the items are severely damaged, ecofuelbox.com reserves the right to refund the price paid by the customer or make a new delivery of similar items.
If the delivery is not quantitatively or qualitatively compliant with the order, and if the customer wishes to keep the items received, ecofuelbox.com undertakes to refund only the possible price difference between the items ordered and those delivered, only if the delivered items are cheaper than those ordered and paid for.
The ordered item will either be exchanged or refunded as soon as possible.

ART. 5
INVALIDITY – FORCE MAJEURE – APPLICABLE LAW – COMPETENT COURTS

In the event that any clause of these General Conditions of Sale is declared invalid or unenforceable for any reason whatsoever, such impossibility will not affect the application of the other provisions of the general conditions; the provision considered inapplicable will then be replaced by the closest possible provision.

ecofuelbox.com shall not be held liable for any non-performance resulting from a case of force majeure, beyond its control, including, but not limited to, cases of war, riot, insurrection, interruption of transport, import or export problems, customs, strike, lockout, item shortages, fire, avalanche, creeping snow, earthquake, storm, flood.

These general conditions are governed by French law.
Any difficulty of interpretation or execution will be the exclusive jurisdiction of the competent courts of Lyon (France). In the event of a dispute or disagreement, after the parties have unsuccessfully attempted to reach an amicable agreement, only the Lyon (France) Commercial Court is competent to settle the dispute.
